By accessing and using MySizer ("Service"), operated by Kakushin.io CY LTD, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms & Conditions, please do not use our Service.

These Terms & Conditions apply to all users of the Service, including without limitation users who are browsers, customers, merchants, and/or contributors of content.

2.1 Eligibility

You must be at least 13 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement.

2.2 Account Registration

• You may be required to create an account to access certain features
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

2.3 Acceptable Use

You agree not to:

• Violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
• Infringe upon or violate our intellectual property rights or the intellectual property rights of others
• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• Submit false or misleading information
• Upload or transmit viruses or any other type of malicious code
• Attempt to gain unauthorized access to any portion of the Service

3.1 Our Content

The Service and its original content, features, and functionality are and will remain the exclusive property of Kakushin.io CY LTD and its licensors. The Service is protected by copyright, trademark, and other laws.

3.2 Your Content

By uploading content to our Service (such as body images for size calculations), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process that content solely for the purpose of providing the Service to you.

You retain all rights to your content. We do not claim ownership of any content you submit.

4.1 Size Recommendations

MySizer provides size recommendations based on AI analysis and algorithms. While we strive for accuracy, we cannot guarantee that our recommendations will result in a perfect fit. Actual sizing may vary by brand, style, and individual body type.

4.2 "As Is" Service

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content

4.3 Limitation of Liability

To the maximum extent permitted by applicable law, Kakushin.io CY LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms & Conditions.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.

We reserve the right to modify or replace these Terms & Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

These Terms & Conditions shall be governed and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms & Conditions will not be considered a waiver of those rights.
